Section 1 – Overview

This website is operated by Habitera Farms LLC, doing business as Very Mulberry. Throughout this site, the terms we, us, and our refer to Habitera Farms LLC / Very Mulberry. Very Mulberry offers this website — including all information, tools, and services available from this site to you, the user — conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, booking a U-Pick reservation, or visiting our farm, you engage in our Service and agree to be bound by these Terms of Service. These Terms apply to all users of the site and visitors to our farm, including without limitation customers, guests, and visitors.

Section 2 – Farm Visit Terms

Very Mulberry operates a physical U-Pick farm at 501 Hoffman Lane, Brentwood, CA 94513. The following terms apply to all farm visitors:

• Waiver Requirement: All visitors must read and sign a Waiver and Limitation of Liability prior to entry. Entry may be refused to anyone who declines to sign.
• Assumption of Risk: Visitors assume all inherent risks associated with outdoor farm activities, including uneven terrain, weather exposure, and insects.
• Children and Minors: Children under 18 must be accompanied and supervised by a responsible adult at all times.
• Farm Rules: Mulberries are sold by container—outside bags/containers are not permitted. Visitors must stay on designated paths. Pets are not permitted (except service animals).

Section 3 – Products & Purchase Terms

Prices for our products—including U-Pick entry, fresh mulberries, juice, and trees—are subject to change without notice. Your order constitutes an offer to purchase subject to acceptance by us.

Cancellations and Refunds:

• U-Pick Reservations: Full refund or reschedule if cancelled more than 48 hours before your visit.
• Late Cancellations: Within 48 hours are non-refundable but may be rescheduled subject to availability.
• No-Shows: No-shows are strictly non-refundable.
• Online Orders: Contact [email protected] within 7 days of receipt for return inquiries.

Section 4 – Third-Party Tools

We use trusted platforms including Square (e-commerce), TicketTailor (reservations), and Klaviyo (communications). These tools operate under their own terms and privacy policies. Very Mulberry is not responsible for the performance or data practices of these third-party vendors.

Section 5 – Limitation of Liability

Your use of the Service is at your sole risk. In no event shall Habitera Farms LLC / Very Mulberry be liable for any indirect, incidental, or consequential damages. Our total liability to you shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Section 6 – Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Contra Costa County, California, under California law, on an individual basis only.
